The agreement that governs your use of Botworks. Effective as of June 2025.
Introduction
Welcome to Botworks, an AI-powered automation platform owned and operated by Botworks. These Terms of Use (“Term”) form a binding agreement between you and Botworks, governing your access to and use of our website (www.botworks.com), platform, products, features, and all associated services (collectively, the “Services”).
Accessing or interacting with our Services in any form constitutes your acceptance of these Terms; by creating an account, subscribing to a plan, or interacting with the platform in any way, you agree to be bound by these Terms. By acting on behalf of an organization, you warrant that you are empowered to accept these Terms on its behalf. In that case, “you” or “your” will refer to the organization.
Please read the Terms of Use carefully before you start to use the Website or the Services. By using the Website or the Services, you accept and agree to be bound and abide by these Terms of Use, our Privacy Policy and any other terms or policies incorporated herein by reference. If you do not want to agree to these Terms of Use including the agreements incorporated by reference herein, you must not access or use the Website or our Services.
We may update these Terms from time to time. The most current version will always be available on this page. All modifications and updates are effective immediately when they are posted. Continued use of the Services after any update means you accept the revised Terms. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.
We reserve the right to revise and update our Website and Services that we offer at any time without notice.
Account Registration
To access certain features of the Botworks platform, you may be required to create an account. When creating an account, please ensure that all information provided is accurate, current, and complete. You may also register using a supported third-party service (such as Google). If you choose, we will collect information from that provider using your privacy settings, including your name, email address, and other shared details.
Your Botworks account is protected by a username and password that you create. You are solely accountable for safeguarding your login credentials and any actions taken under your account. If you detect unauthorized access or unusual activity, please report it immediately to security@botworks.com.
Botworks is not responsible for consequences stemming from your account’s misuse or unauthorized access. However, you may be held responsible for losses incurred by Botworks or others due to misuse of your credentials. You must not use another user’s account without their express permission.
We reserve the right to deactivate unpaid or inactive accounts (those unused for more than 90 days). In such cases, associated data may be permanently deleted. We may provide prior notice and an option to export or back up your data before deletion, to the extent practicable.
Your Content and Customer Data
While using the Services provided by Botworks, you may upload, submit, transmit, or share various forms of content and materials, including but not limited to text, visuals, files, media, attachments, and other digital assets through the platform (“Your Content”).
You may delete your content from the platform at any time, subject to certain exceptions. Content shared publicly (such as reviews or testimonials) or shared with integrated third-party services or partners may persist in some form. It may not be fully removable from all systems. Botworks is not responsible for any loss or failure to delete content in such cases.
By submitting or making Your Content available through our Services, you grant Botworks a non-exclusive license granting us global, royalty-free permission to handle, adapt, display, distribute, and create derivative works of Your Content in accordance with the terms and conditions stated herein.
You represent and warrant that:
- You own or have the full legal rights to all submitted content and data.
- The content does not violate any third party intellectual property, privacy, or publicity rights.
- Your use of the Services and content submission complies with all applicable laws and regulations.
Services
As part of your experience with Botworks, we may offer access to a suite of powerful AI automation tools and supporting resources. These Services may include but are not limited to, product documentation, download areas, developer tools, APIs (Application Programming Interfaces), sample code, training programs, integration assets, and other digital content designed to help you maximize the platform’s value.
Your use of the Services, including any enhancements, updates, or newly released features, is governed by these Terms unless a separate agreement or license applies. Where specific products or services are provided under their own terms, those terms will take precedence and supersede any conflicting or contradictory terms contained herein.
Users must adhere to these Terms and all governing laws while using the platform. We reserve the right to modify or update any part of the Services at any time without prior notice.
Software
As part of your access to Botworks, we may provide software tools, downloadable utilities, and APIs to support the use of our Services. Unless you have a separate, valid agreement with Botworks, you may not copy, reproduce, distribute, sublicense, resell, or otherwise exploit any software available.
Specific tools and features within Botworks include Artificial Intelligence (“AI”) and Machine Learning (“ML”), Generative AI technologies (“GenAI Services”) designed to allow users, whether you, your team members, or your customers, to input queries, prompts, or other data (each, a “Prompt”) and receive AI-generated responses or content (“Output”). These GenAI Services may be accessed through APIs, web-based interfaces, chatbots, or embedded experiences in your software environments.
While we continuously refine our AI models to deliver smarter, faster, and more accurate interactions, Generative AI is inherently probabilistic. The Outputs generated may not always reflect factual, current, or complete information and may unintentionally include content that is inaccurate, outdated, biased, or inappropriate. Any Outputs or other information contained on the Website or provided through the Services is not intended as, and shall not be understood or construed as legal, financial, tax, medical, health, or any other professional advice. Neither botworks.com nor any of its owners or employees shall be held liable or responsible for any errors or omissions on this Website or for any damage you may suffer as a result of failing to seek competent advice from a professional who is familiar with your situation.
By using this Website and the Services, you accept personal responsibility for the results of your actions. You agree to take full responsibility for any harm or damage you suffer as a result of the use, or non-use, of the information available on this Website or the resources available for download from this Website. You agree to use judgment and conduct due diligence before taking any actions or implementing any plans or policy suggested or recommended on this Website. You also recognize that prior results do not guarantee a similar outcome. Thus, the results obtained by others - whether clients of botworks.com or otherwise - are no guarantee that you or any other person or entity will be able to obtain similar results.
As a user of Botworks, you understand and agree that:
- AI Output should not be considered factual without independent validation or review.
- Human oversight is recommended for critical decision-making, especially in regulated, sensitive, or customer-facing applications.
- You are solely responsible for how you use the Output, including ensuring it aligns with your legal, ethical, and operational responsibilities.
- You must inform your users of AI limitations when integrating GenAI Services into your systems or applications.
Use at Your Own Risk
You assume all risks associated with using GenAI Services. Botworks makes no warranties, express or implied, about any Outputs accuracy, reliability, or legality. We are not liable for damages, losses, or harm from your reliance on AI-generated content.
We reserve the right to update, restrict, or discontinue any software or AI functionality at our discretion and without prior notice.
Documentation
Unless otherwise stated in specific licensing terms, any documentation provided by Botworks as part of the Services, including technical manuals, guides, API references, and product-related materials, is intended solely for your internal business use.
This documentation may be annotated, translated, and reproduced reasonably for your team’s internal reference to designing, developing, testing, or supporting your software, products, or services that integrate with or utilize Botworks. You may also distribute limited portions of the documentation as necessary to explain integration or functionality within your internal teams.
However:
- You may not publish any annotations, translations, or modified versions of the documentation in any public forum, including blogs, websites, or printed materials.
- Any copies, whether for internal use or otherwise, must retain the copyright and proprietary information from the original materials.
- Any redistribution or external use of documentation beyond what is explicitly permitted requires prior written consent from Botworks.
Please note: Our platforms documentation and related visual materials may contain occasional typographical errors or technical inaccuracies. We reserve the right to update the documentation without prior notice.
Botworks Academy Training and Learning Materials
All training courses and associated learning materials provided by Botworks, whether delivered online, through live sessions, or as part of the Services, are the intellectual property of Botworks and its licensors. This content is safeguarded under copyright and other relevant legal protections.
Subject to these Terms, Botworks provides you with a restricted, revocable right to access and utilize its training courses for personal or internal business use. This right is non-exclusive, non-transferable, and may not be sublicensed and materials solely for your individual learning or internal business use. This license is time-bound and conditional on your continued compliance with all applicable terms.
You acknowledge and accept that you are prohibited from, either directly or indirectly:
- Copying, reproducing, modifying, adapting, translating, publishing, or creating derivative works from any portion of the training content.
- Distributing, sublicensing, sharing, reselling, or publicly displaying the materials or granting access to others via shared credentials, networks, or time-sharing arrangements.
- Using the courses or content in any commercial capacity outside your organization without express written permission from Botworks.
- Removing, obscuring, or altering any proprietary notices, copyright markings, or brand identifiers in the training materials.
- Digitally transmitting, duplicating, or distributing any part of the training materials through electronic or physical means not explicitly authorized.
You acknowledge and agree that:
Botworks may update or revise training content at its discretion, and such updates may not always be available to all users or remain accessible over time.
Training content is intended as a knowledge aid and should not be considered a substitute for your business judgment, technical expertise, or regulatory responsibilities.
Any improper use of Botworks Academy content is forbidden and may lead to revoked access and potential legal consequences.
Restrictions
The Botworks platform, including this website, its software, APIs, documentation, training materials, and related technologies or content, is protected under applicable U.S. and international laws. This encompasses all categories of intellectual property protections, such as copyrights, trademarks, patents, and trade secrets governed by relevant laws and regulations. Botworks retains all rights not explicitly granted in these Terms. No additional rights are conveyed implicitly or otherwise.
You may only use the platform and its Services in strict accordance with applicable international, federal, state, and local laws and these Terms of Service.
Prohibited Use
You agree not to:
- Use the Botworks platform or Services for any unlawful, unauthorized, fraudulent, or malicious purpose.
- Interfere with or compromise the performance, security, or integrity of the Botworks platform, its networks, or systems or to attempt unauthorized access to any data or content not expressly intended for your use.
- Access restricted platform areas without proper authorization is strictly prohibited, including user accounts, computing environments, or related infrastructure, whether through hacking, password mining, or any other intrusive means.
- Analyze, decode, reconstruct, or otherwise attempt to extract the underlying code or architecture of any software or services provided by Botworks unless explicitly permitted by applicable law.
- Use the platform in a way that violates or circumvents any applicable terms, usage limits, or technical restrictions set by Botworks.
- Perform any action that could compromise, interrupt, overwhelm, or negatively affect the platform, its services, or the seamless experience of other users.
- Modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Website or Services, or any of the resources, material or information available for download or use on the Website.
Botworks retains the right to investigate any breach of these Terms and pursue all applicable legal or administrative remedies deemed appropriate. We may also cooperate with law enforcement authorities where necessary to ensure full compliance with the law.
Botworks’ content is not for resale. Your use of the Website or any of the resources available for download from the Website does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your individual use, and will make no other use of the content without the express written permission of botworks.com and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. The botworks.com name, Botworks logo, Botworks slogan, and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of Botworks or its affiliates or licensors. You must not use such marks without the prior written permission of Botworks. All other names, logos, product and service names, designs and slogans on this Website are the trademarks or service marks of their respective owners.
Prohibited Use
To protect the security, reliability, and integrity of the Botworks platform and its Services, all users are expected to follow responsible usage practices. The following actions are strictly prohibited:
Do not, for example:
- Use bots, engines, scrapers, or any automated tools to access, search, download, or interact with the Botworks platform other than through officially supported public interfaces.
- Access, interfere with, or attempt to access non-public areas of Botworks platform, back-end systems, infrastructure, or cloud and technology partners.
- Probe, scan, or test for vulnerabilities within our systems or networks or attempt to breach security or authentication mechanisms.
- You may not attempt to reverse engineer, decipher, decompile, or disassemble any platform component, its services, or associated software infrastructure.
- Plant, upload, or distribute malware, viruses, or malicious code through the platform.
- Infringe on the privacy, personal data, or identity of other users, customers, employees, or service partners.
- Violate applicable law, regulation, or regulatory guidance in your jurisdiction.
- Impersonate another individual, organization, or Botworks representative, or misrepresent your identity or affiliation.
- You must not transmit, upload, or store any content that constitutes spam, unsolicited communications, or disruptive material, harmful, infringing, obscene, abusive, harassing, libelous, threatening, unlawful, or otherwise violates professional or ethical standards.
- Encourage, facilitate, or enable others to commit the above violations.
Violating these restrictions may result in immediate suspension or termination of your Botworks platform and Services access and may be subject to legal action where applicable.
Community and Communication Guidelines
Some features within the Botworks platform may include communication tools such as chat interfaces, user forums, collaboration spaces, shared calendars, document storage, messaging systems, and other channels (“Communication Services”). These services are intended to foster constructive, professional, and respectful interactions.
By using these Communication Services, you agree to participate in a manner that supports the community, fully complies with relevant legal and ethical obligations, and contributes to a constructive and inclusive user environment.
Prohibited Conduct
To protect the security, reliability, and integrity of the Botworks platform and its Services, all users are expected to follow responsible usage practices. The following actions are strictly prohibited:
While engaging in Communication Services, you must not:
- Utilize these channels to distribute unauthorized promotions, advertisements, spam, chain messages, pyramid schemes, or any other form of unsolicited communication.
- Harass, intimidate, stalk, or otherwise violate the legal rights (including privacy and publicity) of others.
- Share, upload, or distribute offensive, profane, defamatory, obscene, illegal, or otherwise inappropriate content.
- Upload materials protected by intellectual property rights without proper authorization or consent.
- Misuse copyrighted content, trademarks, proprietary software, or trade secrets available through Communication Services.
- Upload or distribute harmful software, including viruses, malware, spyware, corrupted files, or any code designed to damage or compromise systems.
- Post commercial content unless expressly permitted by the guidelines of that specific community feature.
- Download or redistribute materials that are not lawfully shareable or that infringe upon others’ rights.
- Remove or alter copyright notices, ownership attributions, or legal identifiers from any content.
- Interfere with other users’ ability to use or enjoy Communication Services.
- Bypass or violate any codes of conduct, policies, or community guidelines associated with the platform.
- Collect personal information about others, including email addresses, without consent or in violation of applicable data protection laws.
- Create false identities to mislead others or impersonate individuals, organizations, or Botworks representatives.
- Share or distribute user directories, usage data, or other personal or proprietary information without authorization.
Violating these guidelines may result in removing your content, suspension of access, or account termination. Botworks reserves the right to monitor and moderate activity across its Communication Services to maintain a secure and professional environment.
Monitoring and Use of Communication Services
While Botworks is not obligated to monitor user interactions within our Communication Services, we reserve the right to review, moderate, or remove any content shared or posted at our sole discretion. In case of a policy breach or inappropriate conduct, we retain the right to suspend access without prior notice or revoke your access to any or all Communication Services at our sole discretion and without prior notice.
We may also disclose user information if required to comply with applicable laws, legal processes, regulatory requests, or government mandates. Additionally, we reserve the right to edit, refuse to post, or delete any material partially or entirely if we believe it is necessary to maintain the platforms safety, legality, and integrity.
Please exercise caution when sharing personally identifiable information (“PII”) within Communication Services. Botworks neither controls nor endorses user-generated content and makes no guarantees regarding its accuracy, reliability, or suitability. We expressly disclaim any liability for outcomes, losses, damages, or any adverse consequences arising from your use of or participation in these forums.
Certain materials shared in the Communication Services may carry reproduction, distribution, or reuse restrictions. You must comply with all applicable limitations and licensing terms if you download such materials.
Violation of Terms of Service
Botworks reserves the right to suspend or terminate your access to the Services, including deactivating your user account, if it is determined that you have breached these Terms of Service or engaged in any unauthorized, unlawful, or detrimental conduct.
In such cases, we also reserve the right to pursue all applicable equitable and statutory legal remedies to protect our platform, intellectual property, users, and business interests. Maintaining the integrity, security, and compliance of our Services is our highest priority, and any breach of these Terms will be addressed with the seriousness it warrants.
Privacy Policy
Your use of the Website and the Services is also subject to botworks.com’ Privacy Policy. Please review our Privacy Policy, which also governs the Website and informs users of our data collection practices. Your agreement to the Privacy Policy is hereby incorporated into these Terms of Use. Any additional privacy terms stated herein are in addition to the Privacy Policy and are meant to supplement such terms contained in the Privacy Policy.
Responsibility for Customer Data
As our customer, you are solely responsible for the accuracy, quality, and lawful collection of any personal data, whether from end-users or other individuals, you submit to us through your use of the Services ("Customer Data"). You are also responsible for the legal basis by which you acquire and process such data.
If you use our AI-powered or GenAI services, specific data, including Customer Data, may be processed or transferred to third-party AI systems based on your configurations and authorizations. Depending on your settings, this may involve anonymized data or raw content. Once data leaves our secure environment and reaches the third-party AI provider you've authorized, their privacy policies and data handling practices apply. Botworks is not liable for any data once it is transferred outside our system.
You are responsible for informing your end-users and obtaining consent to share and process their personal information within Botworks and through our integrated third-party services.
Your Compliance Obligations
You agree to adhere to all relevant data protection laws, privacy regulations, and compliance obligations applicable to using the Services. If you detect a breach, notify us at security@botworks.com within 24 to 48 hours of discovery (6 hours for Indian customers under CERT-In guidelines).
Transmission and Security Assurance
Botworks has adopted industry-leading security measures and obtained certifications, including ISO/IEC 27001:2013, ISO/IEC 27018:2019, and SOC 2 Type 2\. Our complete security infrastructure is outlined at botworks.com/security.
a. Voice and Text Services
In connection with outbound calls and the transmission of short message services (SMS) and multimedia messaging services (MMS), Botworks provides Voice and Text Services to enable customer interactions and automation workflows. While we strive to ensure seamless delivery, Botworks is not liable for delays, failures, or disruptions caused by third-party wireless service providers (Carriers) or intermediaries (Aggregators) responsible for message and call transmission. These entities manage their infrastructure and may impose additional fees per message, which Botworks will reflect in your monthly invoice, billed in arrears when applicable.
Sometimes, Botworks may send you SMS or MMS messages, such as platform demonstrations or account-related notifications. Your use of the Services constitutes your consent to receive transactional and administrative communications related to your account, service updates, and other operational matters. You can reply HELP for support or STOP to opt-out. Message frequency may vary. Standard messaging and data charges may be incurred as determined by your mobile service provider.
b. Indemnification for Voice and Text Services
- IF THE VOICE AND TEXT DELIVERY PROVIDER ENGAGED BY BOTWORKS (“PROVIDER”) REQUESTS INDEMNIFICATION DUE TO A CUSTOMER’S VIOLATION OF APPLICABLE LAWS WHILE USING THE VOICE AND TEXT SERVICES (A “CLAIM”), THE CUSTOMER AGREES TO INDEMNIFY BOTWORKS FOR SUCH CLAIMS.
- IF THE AGREEMENT BETWEEN BOTWORKS AND THE PROVIDER DOES NOT LIMIT LIABILITY RELATED TO A CLAIM, THEN CUSTOMER’S INDEMNIFICATION OBLIGATIONS TO BOTWORKS SHALL LIKEWISE NOT BE SUBJECT TO ANY LIMITATION OF LIABILITY.
c. Compliance Responsibility
While Botworks offers features that may aid in compliance, they should not be solely relied upon as compliance tools. These features are provided “as is” without warranties, and it remains the Customer’s sole responsibility to ensure adherence to all legal, regulatory, or contractual obligations when using Voice and Text Services.
d. Voice Content and Intellectual Property
Botworks is not responsible for any content, infringement, or misuse resulting from voice interactions or AI-generated voices initiated by or for the Customer. The Customer agrees to fully indemnify Botworks for any claims or damages from such content. In addition, the Customer affirms that:
- They have obtained all necessary permissions and releases from voice actors to generate or clone voice data.
- They have acquired rights for professional voice cloning, where applicable, ensuring all ethical and legal standards are met.
- The Customer must obtain all necessary legal permissions and signed releases from individuals whose voice is used for instant cloning via Botworks voice technologies.
- For professional voice cloning services, the Customer must secure explicit, documented authorization from the voice owners or actors, confirming their consent for usage in professional or commercial applications.
e. Special Provisions for Voice Bot Services in India
- Customers availing Botworks voice bot services in India accept full responsibility for the proper use of phone connections under their name or their end-users names (as stated in the applicable Order Form). This includes ensuring authentic usage, verifying user identity and traceability, and cooperating with any regulatory or law enforcement authority, domestic or international, during security verifications. Compliance with all applicable telecom, legal, and regulatory frameworks is mandatory.
- The Customer is solely responsible for maintaining ongoing compliance with Know Your Customer (KYC) norms, including any legal, regulatory, or governmental directives issued by competent Indian authorities.
- The Customer must ensure that all contact databases shared with Botworks are fully updated and aligned with the National Do Not Call Register (NDNC). Under no circumstance shall the Customer initiate unsolicited commercial communications directly or indirectly to any phone number listed on the NDNC unless explicit and irrevocable consent has been obtained from the subscriber.
- The Customer is solely responsible for ensuring that all content shared via Botworks voice services is appropriate, lawful, and respectful. Under no circumstances should the content include offensive, harmful, misleading, or defamatory material, nor should it incite negative sentiment or breach any applicable legal, ethical, or regulatory standards. Any misuse that harms the public interest or damages the reputation of Botworks or its offerings is strictly prohibited.
- The Customer agrees to fully assist Botworks and its authorized third-party partners in the event of any official investigation or compliance inquiry related to the use of voice services. This includes promptly sharing relevant information and documents electronically within 24 hours of request and in physical form within 48 hours if required.
- To maintain uninterrupted service and compliance with legal standards, the Customer must provide all necessary information, certifications, and documentation requested by Botworks or its affiliated service providers. This includes regular updates and declarations to fulfil local regulatory and operational requirements.
- The Customer accepts full liability for any misuse or breach of voice service terms and agrees to protect and indemnify Botworks, its partners, affiliates, and personnel from any legal claims, penalties, damages, or enforcement actions arising from such violations. This clause covers all potential liabilities related to the Customer’s conduct, content, and failure to meet regulatory obligations.
WhatsApp Business Account
If you choose to use WhatsApp Business functionality as part of your interaction with the Botworks platform, your usage will also be subject to WhatsApp’s official policies. Specifically, your access and use of WhatsApp Business Services are governed by WhatsApp’s Business Terms of Service, which outline the rights, responsibilities, and acceptable use of WhatsApp’s tools for business communication.
By enabling WhatsApp Business capabilities through Botworks, you agree to comply with both these Terms and the applicable WhatsApp Business Terms. You are responsible for reviewing and adhering to all relevant policies to ensure lawful and compliant use of WhatsApp services through our platform.
Links to Third-Party Sites and Services
The Botworks platform may feature links to third-party websites and services, which are independently managed and not affiliated with or governed by Botworks. These links are provided solely for informational, functional, or integration purposes. Botworks does not control or endorse third-party websites content, policies, or practices. We make no warranties or representations regarding any third-party contents accuracy, availability, or reliability.
If you choose to interact with or access any third-party websites or services through the Botworks platform, Your interaction with any third-party websites or services is solely at your own risk. You are advised to consult the applicable privacy policies before proceeding and the terms of service of any third-party websites or providers before engaging with them.
Some of the Services offered by Botworks may integrate or rely on third-party platforms and solutions, such as advertisement bots, WhatsApp bots, generative AI services (GenAI), or other tools provided by partners like Meta, Google, Microsoft, OpenAI, and other cloud or AI providers. These services are made available on an as is and as available basis, and their continued availability is subject to third-party providers policies, approval, and operational discretion.
Using such integrated services, you acknowledge and agree to comply with all applicable policies, terms, and conditions accepted by the respective third-party providers, which may be modified without prior notice. You are responsible for remaining informed of and adhering to any policy updates.
Botworks reserves the right to suspend or terminate your access to such services immediately and without prior notice, at its sole discretion or any portion of the platform dependent on them if a third-party provider discontinues, modifies, or refuses to offer its services or if you violate any applicable third-party usage guidelines or policies. In such cases, Botworks shall not be held liable for any disruption or termination of related functionalities.
Materials Provided to the Website
Botworks does not claim ownership of the materials you provide to the Website (including feedback and suggestions) or post, upload, input or submit to any Website or our associated services (collectively “Submissions”). However, by posting, uploading, inputting, providing, or submitting your Submission you are granting botworks.com, our affiliated companies, and necessary sub-licensees permission to use your Submission in connection with the operation of their internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat your Submission; and to publish your name in connection with your Submission.
No compensation will be paid with respect to the use of your Submission, as provided herein. The botworks.com is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in Botworks’ sole discretion.
By posting, uploading, inputting, providing, or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.
Intellectual Property and Copyright Infringement

Term and Termination

Outstanding Payments
The Customer shall remain liable for all fees incurred up to and including the final service date, including any fees for in-progress work that Botworks has initiated per Customer instruction.
Survival
Any provisions of this Agreement proposed to survive termination, such as payment obligations, confidentiality, indemnification, and limitations of liability, shall remain enforceable and in full effect following termination.
Trial Access
Botworks may offer access to its Platform or Services on a limited-time, free trial or evaluation basis (Trial Access). This Trial Access is provided exclusively for evaluation purposes, allowing potential customers to explore the functionality and benefits of the Botworks Platform before entering into a paid subscription.
Permitted Use
Trial Access is intended solely for the prospective Customers internal evaluation to determine the suitability of the Services. It must not be used for commercial, resale, consulting, profit-generating activity, or competitive research or benchmarking purposes.
Trial Duration and Termination
Botworks reserves the right to terminate or modify Trial Access at any time, with or without notice. Upon the expiration of the trial period or its early termination, all access to the Services will be automatically revoked unless the Customer has transitioned into a paid subscription plan.
Disclaimer of Liability for Trial Access
NOTWITHSTANDING ANY OTHER PROVISION IN THIS AGREEMENT, TRIAL ACCESS IS PROVIDED “AS IS” WITHOUT ANY WARRANTIES, SERVICE-LEVEL COMMITMENTS, SUPPORT, OR INDEMNIFICATION. BY UTILIZING TRIAL ACCESS, YOU ACKNOWLEDGE AND ACCEPT THIS LIMITATION OF LIABILITY.

Governing Law, Arbitration, and Jurisdiction
You hereby expressly waive any and all claims you may have, now or in the future, arising out of or relating to this Website.

Exceptions to Arbitration
Equitable and Injunctive Relief:

These exceptions are strictly limited and do not waive the requirement to arbitrate any other disputes under these Terms. All other matters not under the exclusions above shall remain subject to the binding arbitration process outlined in this Agreements Arbitration section.
Class Action Waiver
Any dispute or claim connected to your use of Botworks Services must be addressed individually and not as part of any collective, consolidated, or class action proceeding. You and Botworks agree that any legal or arbitration proceedings will be conducted solely between the parties and not as a plaintiff, class member, or representative in any class, group, or collective action.
To that end:
- To the fullest extent allowed by applicable law, the parties waive any right to assert any claims against the other party as a representative or member in any class or representative action. To the extent either party is permitted by law or court of law to proceed with a class or representative action against the other, the parties agree that (i) the prevailing party shall not be entitled to recover attorneys’ fees or costs associated with pursing the class or representative action (notwithstanding any other provision in these Terms); and (ii) the party who initiates or participates as a member of the class will not submit a claim or otherwise participate in any recovery secured through the class or representative action.
